This Privacy Policy explains how LION'S POINT LTD, trading as OpenHouse("OpenHouse", "we", "us" or "our"), collects and uses your personal data when you use our website at onopenhouse.co.uk (the "Site") or otherwise interact with us. We are the "controller" of your personal data for the purposes of the UK General Data Protection Regulation ("UK GDPR") and the Data Protection Act 2018.

1. The personal data we collect

• Enquiry & contact data — your name, email address, phone number, and anything you tell us in a message or form (for example when you book a viewing, request information, or ask to speak to an adviser).
• Preference data — the homes and developments you save or shortlist, searches and filters you use, and your budget or requirements if you share them.
• Account data — if you create an account, your login details and saved items.
• Technical & usage data — IP address, device and browser type, pages viewed, and similar analytics data collected via cookies and similar technologies (see our Cookie Policy).

We do not intentionally collect special category data. Please do not send us sensitive personal information through the Site.

2. How and why we use your data (purposes and lawful bases)

• To respond to your enquiries and arrange viewings — lawful basis: taking steps at your request and our legitimate interests in operating the Site and responding to you.
• To introduce you to the relevant property developer whose development you have enquired about, so they (or their sales team) can progress your enquiry — lawful basis: your consent and/or our legitimate interests.
• To refer you to our partner mortgage adviser where you ask about mortgages or use our mortgage tools — lawful basis: your consent. See the note on mortgage referrals below.
• To provide your account and saved homes — lawful basis: performance of our terms with you.
• To send you updates and marketing about new homes and services, where you have asked us to or where permitted by law — lawful basis: your consent, or our legitimate interests for existing enquirers (you can opt out at any time).
• To analyse and improve the Site and keep it secure — lawful basis: our legitimate interests; analytics cookies are used only with your consent.
• To comply with our legal obligations — lawful basis: legal obligation.

Where we rely on legitimate interests, those interests are running an effective new-homes marketing service, responding to you, and improving and securing the Site; we balance these against your rights.

3. Who we share your data with

• Property developers (and their appointed sales agents) for the development(s) you enquire about.
• Our partner mortgage adviser, where you request mortgage help.
• Service providers who process data on our behalf under contract — for example website hosting, cloud storage, CRM/email tools and analytics providers.
• Professional advisers, authorities or acquirers where required by law, to establish or defend legal rights, or in connection with a business sale or reorganisation.

We do not sell your personal data.

4. Mortgage referrals

OpenHouse is not authorised or regulated by the Financial Conduct Authority and does not provide mortgage, financial or investment advice. Our mortgage calculators are estimates only. Where you ask about a mortgage, we introduce you to an FCA-authorised partner mortgage adviser; we may receive a referral fee. Any advice you receive is provided by that adviser under their own terms and privacy notice.

5. International transfers

We aim to keep your data within the UK. Where a service provider processes data outside the UK, we ensure an appropriate safeguard is in place (such as UK 'adequacy' regulations or the ICO's International Data Transfer Agreement/Addendum).

6. How long we keep your data

We keep enquiry and lead data for as long as needed to deal with your enquiry and for a reasonable period afterwards. Our standard retention period is up to 6 years from your last interaction with us, which reflects the limitation period for bringing most legal claims under the Limitation Act 1980 and our record-keeping obligations. We may keep certain records longer where the law requires it, and will delete or anonymise your data once it is no longer needed. Account data is kept while your account is active. You can ask us to delete your data sooner (see your rights below).

7. Your rights

Under UK data protection law you have the right to:

• access a copy of your personal data;
• have inaccurate data corrected;
• have your data erased in certain circumstances;
• restrict or object to processing, including objecting to direct marketing at any time;
• data portability; and
• withdraw consent at any time where we rely on consent.

To exercise any of these, contact privacy@onopenhouse.co.uk. Providing your data is not a statutory or contractual requirement, but if you do not provide contact details we may be unable to respond to your enquiry.

8. Automated decision-making

We do not make decisions producing legal or similarly significant effects about you based solely on automated processing.

9. Complaints

We hope to resolve any concern directly, so please contact us first. You also have the right to complain to the Information Commissioner's Office (ICO) at ico.org.uk or on 0303 123 1113.
